Heard learned counsel for the petitioner(s) and learned A.G.A. for the State.
The challenge herein is to a First Information Report dated 30.03.2021 bearing Case Crime No. 0066 of 2021 alleging commission of an offence by the petitioners under Sections 60(2) U.P. Excise Act and 272 I.P.C., Police Station- Tikoniya, District- Lakhimpur Kheri.
On a perusal of the First Information Report impugned herein it can not be said at this stage that no cognizable offence is made out against the petitioner(s), therefore, we are not inclined to interfere in the matter.
Accordingly, we dismiss the writ petition but without prejudice to the rights of the petitioner(s) to avail other remedies such as under Section 438/439 I.P.C. etc. Order Date :- 21.5.2021 R.K.P.
