Dharmeshkumar vs State

High Court Of Gujarat|24 January, 2012

JUDGMENT / ORDER

This petition under Section 482 of the Code of Criminal Procedure, 1973 is filed by the petitioner with the following main prayer:
[B] Your Lordships may be pleased to quash and set aside the compliant being IR No.15 of 2010 registered before the Women Police Station, Vadodara dated 13.3.2010 to serve the purpose of justice.
2. At the outset, it is to be noted that charge sheet filed against the petitioner is for the offences punishable under sections 498-A, 406, 420, 323, 504, 506(2) and 114 of the IPC and under Sections 3 & 7 of The Dowry Prohibition Act, 1961. From the record, prima facie, it appears that there are specific allegations of making demand of dowry of Rs.10 lakhs, abusing physically and verbally and deceiving the complainant for taking the complainant to United Kingdom.
3. In the above backdrop of charges, the contention of learned advocate for the petitioner that the complaint impugned would not constitute any office, as alleged, on the strength of some correspondence and communication, cannot be gone into at this stage in exercise of powers under Section 482 of the Code of Criminal Procedure, 1973. The same can be scrutinized and adjudicated by the trial Court at an appropriate stage.
In the absence of any merit, this petition stands dismissed.
Notice is discharged.
