Pursuant to order dated 3.9.2012, Ms. Nisha M. Thakore, learned AGP has tendered a compilation which contains application made by the District Collector, Ahmedabad to Chief Electoral Officer, Gujarat State for granting permission to carry out the directions issued by this Court vide order dated 3.9.2012. It is further indicative from the letter written by the District Collector, Ahmedabad to the Chief Electoral Officer, Gujarat State that scrutiny and process of allotment can be completed even during the election period. The only embargo which the Election Commission has provided is that the actual allotment or draw may not be taken. Ms. Nisha M. Thakore, learned AGP, therefore, seeks time till 28.02.2013. Considering the fact that the Election Commission has been kind enough to permit further scrutiny and even the allotment, this Court see no reason to grant time till 28.02.2013. Since the Code of Conduct would be applicable only upto 24.12.2012, as informed by the learned advocates for the parties, the earlier directions issued vide order dated 3.9.2012 and as endeavoured by the District Collector himself in his communications which are produced on record today, time is extended till 31.01.2013. S.O. to 01.02.2013.
