Heard Sri Birendra Singh, learned counsel for the petitioner and Sri Abhishek Shukla, the learned Standing Counsel.
It is submitted by learned counsel for the petitioner that ends of justice would be served, if an appropriate direction is issued to the Collector, Fatehpur to dispose of the pending application dated 25.10.2017 filed by the petitioner under Section 28 of U.P. Land Revenue Act, 1901, to its logical conclusion in accordance with law within a stipulated period.
The learned Standing Counsel submits that he has no objection if an appropriate direction is given to the authority concerned.
The writ petition is disposed of with the direction to Collector, Fatehpur to dispose of the application dated 25.10.2017 filed by the petitioner under Section 28 of U.P. Land Revenue Act, 1901 to its logical conclusion after hearing the parties concerned in accordance with law, as expeditiously as possible, preferably within 4 months from the date of production of certified copy of the order.
It is clarified that the proceedings as far as possible should not be repeatedly adjourned, merely on the ground that the Presiding Officer is busy in administrative work.
Service of certified copy of this order upon the respondent concerned shall constitute sufficient notice upon him to submit a compliance report.
The authority concerned shall submit Compliance report in Chambers on 23.8.2018 at 4:00 P.M.
