The petitioner claims to have been appointed as Seasonal Collection Peon in Tehsil Khaga District Fatehpur and has continued for considerable long period on seasonal basis. It is contended that the petitioner was lastly engaged in the month of March 2014 and thereafter, the respondent did not assign any work to the petitioner despite repeated representation.
It is submitted that a direction may be given to respondent no.3 to consider the claim of the petitioner for engagement on seasonal basis and further to consider his claim for regularization on the post of Collection Peon pursuant to U.P. Collection Peon Service Rules' 2004.
Only submission made during the course of argument is to issue a direction to respondent no.3 to consider the claim of the petitioner keeping in view of the requirement of the Rules 2004.
To this submission, learned Standing Counsel raises no objection.
In view thereof, the writ petition is being disposed of with the direction to the Sub Divisional Officer, Khaga, Fatehpur to consider the claim of the petitioner for fresh engagement on seasonal basis and further his claim for regularization, strictly in accordance with the Rules, in case, the vacancies under the quota for regularization as per the Rules are available in the district concerned.
