The present petition challenges a notice dated 15.11.2019 issued under Section 3(1) of U.P. Control of Goondas Act.
It has been contended that the case, which has been cited, has a cross version to it and injury has been sustained on the side of the petitioner as well and that apart the notice is not in conformity with the provisions of the Act.
There appears to be a beat information also on which reliance has been placed and the first information report of Case Crime No.70 of 2016, which has been cited in the notice, discloses an act to terrorize the people.
Under the circumstances, the appropriate course for the petitioner is to submit his response to the notice and take all legally permissible pleas that may be available to contest the proceedings.
With the aforesaid liberty, the petition is disposed off.
