Heard, Shri Amrendra Nath Tripathi, learned counsel for the petitioner and Shri Pankaj Srivastava, learned Additional Chief Standing Counsel for opposite parties through Video Conferencing.
Submission of learned counsel for the petitioner is that the petitioner had sustained serious injuries while he was on official duty on 23.05.2020 in which his ribs were also broken because of which he has breathing problem also. As per advice of the Doctors he is still on medical leave. However he has been transferred from Kheri to Ayodhya by means of order dated 3rd of January, 2021. The petitioner has made a representation to the opposite party no.3 for stay of his transfer for a period of one year on medical ground. The representation was made on 15.02.2021, but no decision has been taken on the said representation despite reminder dated 20.02.2021. Accordingly he made a prayer for a direction to consider the grievance of the petitioner.
Learned Additional Chief Standing Counsel has no objection to the prayer made by the learned counsel for the petitioner and submitted that the concerned authority shall consider the grievance of the petitioner within the shortest period which may be fixed by this court.
Considering the submissions of the parties and without entering into the merit of the case the writ petition is disposed of with direction to opposite party no.3 to consider and dispose of the representation of the petitioner dated 15.02.2021 sympathetically and expeditiously say within a period of three weeks from the date of production of an internet copy of this order, which may be verified by the concerned authority from the official website of this court.
