Heard Sri Kamal Krishna, learned senior counsel along with Sri Ghan Shyam Das, Advocate appearing on behalf of the applicants and AGA for the State.
The first and foremost submission made by learned counsel is that four persons are said to have caused mar peet with the injured Puran Singh, who sustained single injury and since it is not ascertainable as to which accused had caused this injury, hence the applicant should be granted bail in this case.
Next submission made by learned counsel is that the applicant is said to be armed with brickbat, but there is no allegation in the FIR that any accused was having brickbat.
Having given my thoughtful consideration to the submissions made by the parties counsel and keeping in view all the facts and circumstances of this case, but without expressing any opinion on merit, the applicant may be released on bail.
Let the applicant Dharmendra Singh @ Karu s/o Lala Ram be released on bail in case crime no. 3147 of 2009 under sections 323, 308, 504, 427 IPC, P.S. Kotwali, District Mainpuri on his executing a personal bond of Rs.30,000/- and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
