This petition is filed by the petitioner to quash the Non Bailable Warrant issued against the applicant on 27.11.2015 and 23.9.2018 in Case Crime No. 20 of 2002 under section 354 I.P.C. P.S. Munderva district Basti(State Versus Dharmendra Kumar) pending in the court of Chief Judicial Magistrate, Ist Basti.
After arguing at some length, learned counsel for petitioner submits that grievance of petitioner would be sufficiently met in case bail application of petitioner is considered expeditiously in accordance with law.
In view thereof, it is provided that if the petitioner surrenders before the Court below within ten days from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of ten days, no coercive steps shall be taken against the petitioner.
With the aforesaid, the petition is disposed of.
