Learned counsel for the petitioner is permitted to implead the Gaon Sabha as a party in the writ petition. He may also serve a copy of the writ petition on the counsel for the Gaon Sabha.
Heard learned counsel for the petitioners, learned Standing Counsel and Sri R.C. Upadhyay, learned counsel for the Gaon Sabha.
The application filed by the petitioners under Section 101 of the U.P. Revenue Code, 2006 is pending consideration before the Sub-Divisional Magistrate, Tehsil Sadar, District-Azamgarh.
It is therefore, directed that the application would be disposed of within two months from the date of presentation of a certified copy of this order.
Since the petitioners have admitted in the application that they were ready to exchange their land in Plot No.432, 972 with the Gaon Sabha land bearing No.1106(M) the local officials are deeming irregular possession of the petitioners over Gaon Sabha land.
Till the application is decided or for a period of two months, whichever is earlier, status quo as of today shall be maintained.
The writ petition is disposed of.
