Petitioner has approached this Court with the grievance that though he has passed B. Ed. examination in the year 2005 by securing 415 marks, which included 135 marks in practical test but his mark-sheet is not being verified by the University.
Sri Vivek Rai, learned counsel for the respondent has obtained instructions from the University, according to which petitioner's mark-sheet is tampered inasmuch as he has actually secured 100 marks in the practical test. Copy of the instructions has been furnished to the counsel for the petitioner today, in Court.
Once the petitioner's mark-sheet is found to be tampered, the respondents cannot be said to have acted arbitrarily in refusing to certify petitioner's B. Ed. mark-sheet of the year 2005.
Dismissed, accordingly.
