Heard learned counsel for the revisionist and learned A.G.A. for the State.
This application in revision is directed against the order dated 12.11.2010 passed by Additional Sessions Judge, Court No. 6, Varanasi by which Criminal Appeal No. 50 of 2010 preferred by the revisionist against the order dated 18.02.2010 passed by Special Chief Judicial Magistrate, Varanasi in Misc. Case No. 369 of 2008 (Smt. Sharmila Devi Versus Dharmendra Kumar), under Section 12(1) Domestic Violence Act, Police Station Chetganj, Varanasi granting interim maintenance to the opposite party at the rate of Rs.1000/- per month to the opposite party has been dismissed.
After having perused the impugned order and the other materials brought on record, I do not find that the orders passed by the Court below suffer from any illegality or infirmity warranting any interference by this Court.
The prayer for quashing the impugned orders is refused. However, it is directed that the Special Chief Judicial Magistrate, Varanasi shall made every possible endeavour to decide the Case No. 369 of 2008 (Smt. Sharmila Devi Vs. Dharmendra Kumar), under Section 12(1) Domestic Violence Act, Police Station Chetganj, District Varanasi as expeditiously as possible preferably within a period of two months from the date of production of certified copy of this order before him.
