Heard the learned counsel for the petitioner and Sri Abhishek Mishra who appears for the respondent nos. 1 to 5.
Learned counsel for the respondent nos. 1 to 5 has raised a preliminary objection regarding the maintainability of the writ petition on the ground that the petitioner has challenged the orders dated 24.1.2016 and 26.7.2018 passed by the respondent nos. 1 & 2 respectively.
The petitioner has statutory remedy of filing an Appeal before the Appellate Authority i.e. General Manager, (H.R.) Syndicate Bank, Corporate Office, Bangaluru.
Learned counsel for the respondents says that there a limitation of filing an Appeal within forty days of the order impugned.
This Court disposes of this writ petition with a direction to the petitioner to file his Appeal within fifteen days. In case the petitioner files the Appeal within the time as provided by this Court, the General Manager - the Appellate Authority shall not reject the petitioner's Appeal only on the ground of delay and shall decide the same on merits within a period of four months from the date a certified copy of this order is produced before him.
