It appears to this Court that under the order impugned, the Tehsildar Mant, District -Mathura has cancelled the Scheduled Tribe Certificate as would be done by verification from the record by Administrative Committee under Scheduled Castes and Scheduled Tribes Orders (Amendment) Act 1976.
We have called upon learned Standing Counsel to make submission in this regard and we found from the submission of both learned Counsel for the petitioner and learned Standing Counsel that Tehsildar might be recommending authority but not entitled to pass such final order. Hence, the impugned order dated 4.1.2007 is set aside. However, it is open to the Administrative Committee/competent authority to pass appropriate order in this respect. The writ petition is allowed.
