Dharmendra Alias Dhaniram And ... vs State Of U.P.

High Court Of Judicature at Allahabad|04 January, 2010

JUDGMENT / ORDER

Heard learned counsel for the applicants, Shri R.B. Shukla, learned counsel for the complainant and learned AGA.
It is argued by the learned counsel for the applicants that five persons have received injuries from the side of the applicants, which included firearms wounds. There is no explanation of these injuries in the prosecution version. For ulterior considerations the police submitted final report in the FIR which was lodged from the side of the applicants and an application under section 156(3) Cr.P.C. was moved and the opposite party were even arrested pursuant to the same.
It is further argued that there is no specific role against the applicants.
Per contra, learned AGA and learned counsel for the complainant opposed the prayer for bail and stated that the final report was submitted in the FIR lodged by the applicants.
In this view of the matter, without making any comments on the merits of the case, let the applicants Dharmendra alias Dhaniram and Banwari, involved in case crime No. 516 of 2009, under sections 147/148/149/307/302 IPC and 7 Criminal Law Amendment Act, police station Rajepur, district Farrukhabad, be released on bail on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
