Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the material on record.
By means of this petition, the petitioners have prayed for quashing of the proceedings of Criminal Case No. 79 of 2004 MT/103/06 (State Vs. Dharmendra and others) on the basis of charge sheet No. NCR 46/04 dated 3.9.2005.
It is submitted by learned counsel for the petitioners that there is no material for prosecuting the petitioners on the basis of charge sheet and submits that charges have not yet been framed.
Considering the facts and circumstances of the case I do not find any ground for interference to quash the proceedings under section 482 Cr.P.C.
However, regarding submission of counsel that there is no material to frame charge against the petitioners, it is provided that if charges are not framed against the petitioners, they will have ample opportunity to argue before the trial court at the time of framing of charge.
With these observations this petition is finally disposed of.
