1. Rule.
Mr. Pandya, learned APP waives service of notice of Rule.
2. The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to repair his house.
3. It appears from the jail report that the applicant-convict was recently released on temporary bail from 05.11.2011 to 14.11.2011. Further, the ground is not such where his presence can be said to be indispensable.
4. Hence, the discretion does not deserve to be exercised. Therefore, the application is rejected. Rule is discharged.
