The present 482 Cr.P.C. application has been filed for a suitable direction to the learned Additional Sessions Judge, Ghazipur to decide the Criminal Misc. Application No.70 of 2018 (Dharm Chand Vs. State of U.P.), under Sections 452 Cr.P.C. arising out of Criminal Case Number 101 of 1998 (State Vs. Babban Chaudhary) in Case Crime No.187 of 1998, under Sections 8/27A N.D.P.S., Police Station Jangipur, District Gazipur, pending in the Court of learned Additional Sessions Judge, Ghazipur, within stipulated period.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to learned Additional Sessions Judge, Ghazipur to consider and decide the Criminal Misc. Application No.70 of 2018 (Dharm Chand Vs. State of U.P.), under Sections 452 Cr.P.C. arising out of Criminal Case No.101 of 1998 (State Vs. Babban Chaudhary) in Case Crime No.187 of 1998, under Sections 8/27A N.D.P.S., Police Station Jangipur, District Gazipur, pending in the Court of learned Additional Sessions Judge, Ghazipur, most expeditiously, preferably within a period of two months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
