Heard learned counsel for the petitioner and Sri Suresh Singh, learned counsel for respondents no.1 to 3.
The petitioner by means of present writ petition has prayed for following reliefs:-
"(i). to issue a writ, order or direction of mandamus commanding and directing the Respondent no.-1/Managing Director, Uttar Pradesh Jal Nigam (Urban), Lucknow to pay the Gratuity and G.I.S. of the petitioner with interest accrued thereon, within a stipulated period as fixed by this Hon'ble Court.
(ii) to issue a writ, order or direction of mandamus commanding and directing the Respondent no.-1/Managing Director, Uttar Pradesh Jal Nigam (Urban), Lucknow to pay interest at the rate of 12% per annum till the actual payment of the aforesaid withheld fund of the petitioner."
Sri Suresh Singh, learned counsel for Jal Nigam, on instructions, states that the retiral dues of the petitioner shall be released within three months from today.
The writ petition is disposed of in the light of the statement noted above. It is provided that if the amount is not released within the aforesaid period, the same shall carry interest of 10% from the date the amount becomes due till the date of payment.
