The petitioner was working as a part time Clerk in Elanthaikoodam Panchayat (3rd respondent) and by order dated 2.5.2003 he was placed under suspension on the ground that disciplinary proceedings are to be initiated against him. Challenging the order dated 2.5.2003, the petitioner filed the present writ petition on 26.06.2003 and the matter was posted for admission on 11.12.2003. This court had granted interim stay, on 11.12.2003, of the order of suspension.
2. Today, when matter was taken up for hearing, the learned counsel for the Panchayat submitted that the petitioner was dismissed from service on 4.12.2003 itself and only thereafter the writ petition came up for admission on 11.12.2003.
3. In view of the above, this Writ Petition is dismissed as infructuous with liberty to the petitioner to work out his remedy in a manner known to law, if the cause of action still survives. No costs. Consequently, the connected Miscellaneous Petition is closed.
