ORDER: (per Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
We think that this Court should not entertain this writ petition, as, in our view, this writ petition is not maintainable. However, the point raised before us can be taken care of by the learned Arbitrator under Section 16 of the Arbitration and Conciliation Act, 1996. We therefore observe that the learned Arbitrator will decide the question of jurisdiction and proceed on it in accordance with law.
2. The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
