JUDGMENT / ORDER

THE HONOURABLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.32548 of 2014 Dated: 30.10.2014 Between:
Dharavath Santosh .. Petitioner and The State of Telangana, Rep. by its Principal Secretary, Education, Telangana Secretariat, Hyderabad, and another.
.. Respondents Counsel for the Petitioner: Mr. C.S.N. Raju Counsel for Respondent No.1: G.P. for Higher Education Counsel for Respondent No.2: Mr. A. Abhishek Reddy The Court made the following:
ORDER:
This writ petition is filed for a Mandamus to declare the inaction of respondent No.2 in considering the petitioner’s representation dated 20.09.2014 as illegal and arbitrary.
The petitioner averred that he belongs to S.T. category and that he appeared for EAMCET-2012 examination held on 12.05.2012 and secured rank of 15594. That on 11.07.2013, he has made an application to the Registrar of Acharya N.G. Ranga Agricultural University, seeking admission into B.V.Sc. & A.H. or Agriculture B.Sc. course. That no seat was allotted to him though students who secured less marks were given admission. The petitioner further averred that he made a representation on 20.09.2014 to respondent No.2 to allot a seat to him in any of the existing vacancies and that the same is not being considered.
At the hearing, Mr. C.S.N. Raju, learned counsel for the petitioner, is unable to state as to whether any provision exists under the Regulations pertaining to conduct of EAMCET, which enables respondent No.2 to allot a seat to a candidate based on a rank obtained by him in the examinations of previous years. In my opinion, in the absence of any such provision, the very representation made by the petitioner to respondent No.2 is ill conceived and consequently no Mandamus can be issued to respondent No.2 to consider such representation.
The writ petition is accordingly dismissed. As a sequel to the dismissal of the writ petition, W.P.M.P.No.40692 of 2014 shall stand disposed of as infructuous.
