(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned counsel Mr.Vaghela for the appellant states that at his cost and risk, he may be permitted to delete respondent Nos.2 and 3 since respondent No.2 was Secretary and respondent No.3 was Member of the Society.

Permission as sought for is granted. Registry is directed to delete the names of respondent Nos.2 and 3 from the record.

In view of averments made in the application, present civil application is allowed. Delay of 28 days caused in preferring the Letters Patent Appeal is condoned. Rule is made absolute.
