This application has been filed with a prayer to allow this application directing the Additional District and Sessions Judge, Nagina, District Bijnor to decide the bail cancellation application No. Kha58/1 and 58/2 dated 21.09.2017 in Sessions Trial No. 527 of 2015 (State Vs. Niranjan & others) under section 307, 324, 427, 389, 120-B, 504, 506 IPC arising out of Case Crime No. 1036-C of 2005, police station Nagina Dehat, District Bijnor within a stipulated period.
It is contended by learned counsel for the applicant that brother of the applicant namely Virender Singh has died, was the injured witness in Sessions Trial No. 527 of 2015. Next argued that the applicant has moved an application for cancellation of bail of opposite party no. 2 and 3 which is pending since 27.04.2018. Next submitted that the only prayer of the applicant is that the application No. Kha58/1 and 58/2 dated 21.09.2017 including the bail cancellation application may be disposed of within a stipulated period.
Considering the same, learned trial court concerned is directed to dispose of the application No. Kha58/1 and 58/2 dated 21.09.2017 including the bail cancellation application of the applicant in accordance with law preferably within two months from the date of production of certified copy of this order subject to cooperation of the parties concerned.
With the above observation, this application is disposed of.
