The petitioner contends that though an award was made under the provisions of the Land Acquisition Act, 1894 (hereinafter referred to as the 'Act') and other tenure holders have been paid compensation, but the petitioners, who are the heirs of Chhidda Singh, have not been paid compensation.
It transpires from the records of the writ petition that the petitioners have filed a representation before the Special Land Acquisition Officer, Gautam Budh Nagar for payment of compensation, but according to learned counsel for the petitioners, a decision has not been taken till date.
Learned Standing Counsel appears for respondent Nos. 1 and 3, while Sri B.B. Jauhari, has put in appearance on behalf of respondent No.2.
Learned Standing Counsel states that a decision shall be taken on the representation filed by the petitioners expeditiously.
This petition is, accordingly, disposed of with a direction to the Special Land Acquisition Officer, Gautam Budh Nagar to take a decision on the representation filed by the petitioner after hearing the parties concerned, expeditiously and preferably within a period of three months from the date a certified copy of the order is filed by the petitioners.
It is made clear that the Court has not adjudicated on the merits of the claim of the petitioners, which shall be examined by the Special Land Acquisition Officer, Gautam Budh Nagar in accordance with law.
