JUDGMENT / ORDER

Court No. - 40
Case :- MATTERS UNDER ARTICLE 227 No. - 5678 of 2019 Petitioner :- Dharam Raj Respondent :- Civil Judge And 6 Others Counsel for Petitioner :- Sheetala Prasad Pandey
Hon'ble Manoj Kumar Gupta,J.
The sole prayer made in the instant petition is for issuing direction to the trial court to decide Original Suit No.737 of 2004 within a specified time frame.
The suit has been instituted by the petitioner for permanent injunction and for partition. A perusal of the order sheet reveals that even application for temporary injunction has yet not been disposed of by the trial court and only dates are being fixed in the matter.
Having regard to the fact that the suit is pending since the year 2004, the trial court is directed to proceed with the case with a sense of expedition and conclude the trial by fixing short dates and without granting unnecessary adjournments to the parties.
The petition stands disposed of accordingly.
