This Criminal Misc. Application under Section 482 Cr.P.C. has been filed with the prayer to pass and order court below if applicant move the application on same day in case crime no. 463 of 2003, under Section 459 IPC,P.S. Hathras Junction, District-Hathras. Heard learned counsel for the applicants, learned A.G.A. and perused the record.
Learned counsel for the applicants submitted that the applicant and complainant are brothers and in counter blast, the complaint was lodged. The prayer is for consideration of bail application, expeditiously, preferably on the same day. In view of the fact of the present case, it is provided that if applicants appear and surrender before the court below and move bail application within a month from today, then the same shall be considered, expeditiously, in accordance with law, in view of the law laid down by Full Bench of this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004(57) ALR 390 and affirmed by Hon'ble Supreme Court in Lal Kamlendra Pratap Singh Vs. State of U.P. and others 2009(2) Crime 4 SC after affording the opportunity to the public prosecutor.
