Heard Shri S.P. Mishra, learned counsel for the petitioner and Shri B. B. Pandey, learned Additional Chief Standing Counsel for the State respondents.
The present writ petition was taken up on 15.11.2018 and the Court has proceeded to pass following order:-
"Heard Sri Surendra Prasad Mishra, learned counsel for the petitioner and Sri Gaurav Singh, learned Standing Counsel for the respondents.
It is alleged that certain irregularities and anomalies were being committed by the ration card dealer Smt. Raj Bala on which an enquiry was also instituted and the enquiry report was submitted on 27.7.2018, Annexure-2 to the writ petition but no action has been taken thereafter on the same.
Learned Standing Counsel to obtain instructions and inform the Court as to what action has been taken on the enquiry report.
Put up as fresh on 19.11.2018."
On the matter being taken up today, learned Standing Counsel has placed instructions dated 24.11.2018 sent by Sub Divisional Magistrate, Hasanpur, District Amroha, whereby, it is informed to the Court that the charges levelled against Smt. Rajbala, the ration dealer of the village, were has been confirmed as partly correct and as such, the third respondent has issued show cause notice on 03.11.2018 to Smt. Rajbala, which was received to her on 12.11.2018 and thereafter a reminder has also been issued vide letter no.440 dated 20.11.2018 and now her explanation is awaited. The said instructions are taken on record.
Once such is the factual situation that the matter is already seized by the Competent Authority and the proceeding is on, then in such a situation, this Court is of the considered opinion that let the said proceeding may be finalized by the Authority Concerned expeditiously and at the same time, the Court is also expected that proper opportunity of hearing may also be provided to Smt. Raj Bala.
With these observations, the Writ Petition is disposed of.
