Supplementary affidavit is taken on record. Heard learned counsel for the petitioner.
Petitioner is before this Court with a request that the second respondent may be asked to decide the application (Paper No. 148C) dated 23.7.2018 pending in Original Suit No. 1081/1992 (Tirthraj Vs. Baliraj and others) expeditiously.
Learned counsel for the petitioner states that the aforementioned suit is pending since 1992. The defendants-respondents are raising all sorts of constructions at the road side and in this backdrop, the aforementioned application has been moved by the petitioner which is pending consideration. He further apprised to the Court that the court concerned is vacant and long dates are being assigned to the petitioner and as such request has been made for expeditious disposal of the said application and till disposal of the same, the status quo as on today should be maintained by the parties.
In the facts and circumstances, without adverting on the merits of the case, the writ petition stands disposed of asking the petitioner, in case, he has any grievance that the court concerned is vacant for a long time, in such situation, he is at liberty to move an appropriate application before the District Judge concerned and in case, such an application is moved by the petitioner, the District Judge would ensure that the matter may be referred to a competent court at the earliest so that the same may be decided expeditiously, without according any unnecessary adjournments to either of the parties.
