Heard learned counsel for the petitioner, Sri Manoj Kumar Yadav for the Gaon Sabha and the learned Standing Counsel.
This petition evidently is the second foray of the petitioner alleging encroachments having been made by the private respondents on plot Nos. 119, 120 and 121.
On an earlier P.I.L. which was filed, a learned Judge had disposed of the petition with a direction to the Assistant Collector to duly enquiry into the complaint made and take further action, if warranted. Pursuant to that order a spot inspection was undertaken by the revenue officials in the presence of residents of the locality. That report has been placed at annexure-4 to the writ petition. The report establishes that after due demarcation, it was found that no encroachments had been made. It is thus, manifest that this petition is devoid of merit, which is accordingly dismissed as such.
