Heard Mr. Anwar Hussain, learned counsel for the petitioner and Mr. Vikas Budhwar, learned counsel for respondents- Corporation.
The prayers made in the writ petition read thus:
“(i). to issue a writ, order or direction in the nature of certiorari calling for the records and quash the entire tender process pertaining to Tender No.17000170-HD-10157 for road transportation of bulk white oil petroleum products from Kanpur Terminal to locations within the State and outside the State.
(ii). to issue a writ, order or direction in the nature of mandamus directing the respondents to initiate the tender process afresh and to consider the petitioner's tender pertaining to Tender No.17000170-HD-10157 for road transportation of bulk white oil petroleum products from Kanpur Terminal to locations within the State and outside the State.”
Counsel for the respondents-Corporation, at the outset, invited our attention to the work orders issued in favour of successful tenderers. Even the petitioner, in the dates and events, has clearly stated that the work orders have already been issued. In view thereof, we asked counsel for the petitioner again and again whether he would like to add the successful tenderers as party-respondents. He, every time, submitted that the petitioner has not been officially informed about the final outcome of the tenders and hence he would not like to add them as party- respondents. He submitted that the writ petition may be decided on merits. Even on merits, he did not make any submission as such except that the petitioner's quotation was the lowest and it ought to have been accepted. At this stage, he again submitted that respondents may be directed to communicate to the petitioner that his tender has been rejected and it is awarded to some other parties.
In this view of the matter, we have no option but to dismiss the writ petition. Order accordingly.
