Heard counsel for the petitioner and learned Standing Counsel. Copy of the instruction received by him is taken on record.
The writ petition has been filed seeking following relief:
"Issue a writ, order or direction in the nature of Mandamus directing the respondents to take appropriate action with regard to construction of Shiv Temple situated in Village Mirjapur Kishundaspur Tehsil Sadar District Fatehpur and the respondent no. 6 be restrained that they may not interfere in the construction of Shive Temple situated in Village Mirjapur Kishundaspur Tehsil Sadar District Fatehpur."
From the statement made by counsel for petitioner and also from the instruction received, it is clear that the petitioner is seeking permission to raise temple over land belonging to Goan Sabha.
In my considered opinion such a permission cannot be granted.
In case the petitioner is keen about constructing the temple, he may do so on his own land. The petitioner has no right to construct temple over land belonging to the Goan Sabha.
For the same reason the mandamus prayed for in this writ petition cannot be issued.
Subject to above this writ petition is dismissed.
