This appeal was filed by the appellant, namely, Dhanni Singh son of Mudda against the judgment and order dated 23.05.1992 passed by Vth Additional Sessions Judge, Bijnor in Sessions Trial No. 202A of 1988.
As no one had appeared on behalf of the appellant on 19.07.2019, bailable warrant was issued against the appellant.
Pursuant to the order dated 19.07.2019, the Chief Judicial Magistrate, Bijnor has submitted a report dated 21.08.2019 that the appellant (Dhanni Singh) had died about 10-12 years ago. The report is accompanied by the statements of witnesses, who have deposed that the appellant is no more alive.
In view of the above, the present appeal stands abated.
