Heard learned counsel for the petitioner, learned counsel for the Gaon Sabha and the learned Standing Counsel for the State.
Present writ petition has been filed beseeching expeditious disposal of Appeal No. 27/A of 2020 (Nand Kishsore Lal vs. Shiv Lal), under Section 207 of U.P. L.R. Act, pending in the court of Additional Commissioner (respondent no. 2).
It is submitted that the respondent no. 4 (Nand Kishore) has preferred an appeal dated 21.09.2020 under Section 207 of U.P. Revenue Code, 2006 against the order dated 14.02.2020 passed under Section 116 of U.P. Revenue Code, 2006. In the aforesaid appeal present petitioner is arrayed as respondent no. 9. The appeal is still pending despite the fact that all the respondents have already appeared in the aforesaid appeal and the matter is ready for final adjudication.
Learned Standing Counsel as well as learned counsel for the Gaon Sabha have no objection in case the aforesaid appeal is directed to be decided within a stipulated period fixed by this Court.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Additional Commissioner (Respondent No.2), before whom the appeal is pending, to decide the same expeditiously, preferably, within a period of five months from the date of receipt of a certified copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
With the aforesaid direction, present writ petition is disposed of.
