JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Mr.Pandya, learned APP, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail since he wants to attend the construction of the house on the plot alloted to his widow sister-in-law (brother's wife).
From jail remarks, we find that the applicant-convict was on furlough leave from 14th February, 2012 to 27th February, 2012. Further we also find that the cause is not such where the presence of the applicant can be said to be indispensable.
Under the circumstances, the discretion does not deserve to be exercised. Hence, the application is rejected. Rule discharged.
