These three applicants namely (1) Dhaniram Ramchandra (2) Jesinghbhai Bhanabhai Nal and (3) Aaltafhusen Ahmedbhai preferred this application .They have tendered their objections to the scheme of revival and also to the proceedings for obtaining sanction of this Court which is pending being Company Petition No.264 of 2008.
Learned advocate Mr.Vakil appear for River Front Pvt. Ltd. (RFPL) and learned advocate Dr.Amee Yajnik appear for respondent No. 3 - Official Liquidator.
By filing an affidavit dated 18th April, 2012, petitioner have withdrawn their objections to the sanction sought of scheme of revival in Company Petition No. 264/08 and further requested that that they have no objection against payment made to all the workers. Therefore, unconditional withdrawal has been sought for.
Learned advocate Ms. Yajnik objecting to this withdrawal requests to keep this matter with the main Company Petition No. 264 of 2008 instead of permitting the applicant to withdraw at this stage.
This application is fixed along with Company Petition No. 268 of 2008 which shall be heard on 8th May, 2012.
