The instant petition has been filed challenging a final judgment and decree dated 31.05.2018 passed in Original Suit No. 170 of 2013.
It is well settled that against the judgment and decree passed by the trial court, appeal under Section 96 of the Civil Procedure Code would lie.
Under the circumstances, the petition under Article 227 of the Constitution of India is completely misconceived and is, accordingly, dismissed with liberty to the petitioner to file appeal against the impugned judgment and decree.
