JUDGMENT / ORDER

The petitioner is the accused in crime No.2370/2014 of Mathilakam Police Station of Thrissur district, for offences under Section 3(a) read with Sections 4, 5(1) read with Sections 6, 7(m) read with Sections 8, 11(a) read with Section 12 of the Protection of Children From Sexual Offences Act, 2012. The gist of the allegation is that the petitioner herein had given chocolates, soft drinks etc. to the minor victim boy aged 7 years and taken him to the house of the petitioner and thereafter, induced him to do unnatural acts, which led to the alleged commission of offence. Sri.Sreekumar G. Chelur, the learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this crime due to political rivalry and that the petitioner belongs to a left wing party and that the father of the victim boy belongs to a right wing party and that various occasions, which led to the victim's father being inimical terms with the petitioner. The learned counsel for the petitioner would pray that the petitioner would undertake to fully co-operate with smooth conduct of the investigation and would comply with any conditions that are found necessary by this Court for protecting the bonafide interest of prosecution and that the petitioner may be granted the relief of pre-arrest bail in this case. 2. The learned Public Prosecutor, on instructions, would submit that the offences alleged against the petitioner are very grave and serious in nature and the offences allegedly committed by the petitioner are against a seven year old minor victim boy and that the investigation is only at the preliminary stage and that the prosecution is opposing the pre-arrest bail.
3. Having considered the submissions of the learned counsel for the petitioner and the learned Public Prosecutor and on evaluation of the totality of the facts and circumstances of this case, this Court is inclined to hold that this is not a fit case to grant the relief of pre-arrest bail at this stage, taking into account the gravity of the offences involved and that the investigation is at the preliminary stage. Accordingly, this application for anticipatory bail stands dismissed.
