Heard learned counsel for the petitioner and Shri Satish Chaturvedi, learned counsel for the respondent no.3. Respondent nos.1 and 2 are represented by the learned Standing Counsel.
By means of this writ petition, the petitioner seeks the quashing of the recovery certificate dated 03.03.2021 that has been issued under the provisions of Section 3 of the Uttar Pradesh Public Moneys (Recovery of Dues) Act, 1972.
It is contended by the learned counsel for the petitioner that the petitioner is entitled to the benefit of the scheme called 'Redeeming Crop Loan' in terms of the Government Order dated 24.07.2017 issued by the Government of Uttar Pradesh.
It is contended by Shri Satish Chaturvedi, learned counsel for the respondents, that it is for the petitioner to agitate the matter before the civil court by filing a suit after complying with the provisions of Section 203 of the U.P. Revenue Code, 2006, if he wishes to challenge the recovery certificate which reflects the amount to be recovered from the petitioner as arrears of land revenue.
The learned counsel for the respondent is correct in his contention.
This writ petition is, accordingly, dismissed on the ground of alternative remedy.
