1. Learned Advocate Mr. Shah with learned Advocate Mr. Chirag Trivedi for the appellant has placed on record communication dated 9.2.2012 on the basis of which, he stated that the default account for which respondent No.1 Bank had to institute the suit, has been settled. Learned Advocate Mr. M.B. Gandhi for respondent Bank has, under the instructions from Shri Mukund D. Patel, officer of the bank, who is present before the Court, stated that the Bank does not dispute this communication.
2. In view of this development, learned advocate for the appellant sought permission to withdraw the appeal. Permission granted. The appeal stands disposed of as withdrawn with liberty to apply in case of difficulty. No order as to costs. R&P to be transmitted to the trial Court.
