1. Dhananjay Singh has preferred this special appeal challenging order dated 11.9.2006 rendered in Writ Petition No.5174 (SS) of 2002 titled 'Dhananjay Singh vs. U.P. Cooperative Sugar Federation Ltd. and another.
2. Learned counsel for the appellant has not appeared to prosecute the appeal. The appeal relates to the year 2006. 13 years have gone by. We find no justifiable reason to adjourn the case to await appearance of the counsel.
3. We have gone through the contents of the impugned order, and the pleadings.
We find that the impugned order has been passed while taking into account law laid down by Hon'ble Supreme Court of India vide AIR 2003 SC 4531, General Manager Kisan Sahkari Chini Mills Ltd. Vs. Satrughan Nishad and others. Vide the said judgment it has been held that cooperative sugar mill is not an instrumentality of the State, and therefore writ would not be maintainable against the sugar mill.
Learned counsel for the appellant has not appeared to demonstrate law otherwise.
We find that the order at issue has been passed in terms of law rendered by Hon'ble Supreme Court of India. We find no reason to differ with the view in special appeal jurisdiction.
