Heard Sri Deepak Kumar Tripathi, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This application has been filed with a prayer to quash the order dated 10.05.2019 passed by Special Judge SC/ST Act, Kaushambi in Application No. 268-A of 2018 and 289 of 2018 (State Vs. Anuj Pathak), arising out of Case Crime No. 267 of 2018, under sections 379, 411, 504, 506 IPC and section 3(2) (5A) & 3(1)Gha of SC/ST Act, Police Station Sarai Akil, District Kaushambi.
Submission of learned counsel for the applicant is that vide impugned order dated 10.05.2019, the release application filed by the applicant was turned down by learned Special Judge, SC/ST Act, Kaushambi without applying the judicial mind.
Considering the submissions advanced by the parties as well as perusing the record, this court does not find any illegality or perversity in the impugned order. The present application under section 482 Cr.P.C. is not maintainable, accordingly it is dismissed with liberty to the applicant to avail appropriate remedy before appropriate forum.
Let certified copy of the impugned order be returned to learned counsel for the applicant within 15 days after retaining the photocopy of the same.
