Heard learned counsel for the appellant and the learned A.G.A for the State.

Learned counsel for the appellant submitted that the appellant has been in jail for about 7 years and 8 months. It is a case of double murder and an argument has been raised by the learned counsel for the appellant that as two witnesses noticed that the appellant had assaulted on the chest of the deceased Umed Ali and Shan Mohammad's thigh and stomach by a Khukari and the same was recovered from the appellant.
The above argument raised by the learned counsel for the applicant shall be considered at the time of hearing.
Learned A.G.A. opposed the prayer for bail.
In this view of the matter without expressing any opinion on the merit of the case, we are of the opinion that the appellant has not made out the case for bail. His prayer for bail is refused.
However, the hearing of the appeal is expedited. Office to prepare the paper book within three months and to list the appeal thereafter for hearing before the appropriate Bench.
