Matter is taken up through video conferencing.
Shri Dhananjay Kumar, learned counsel appears for the petitioners. Shri Kundan Rai, learned counsel appears for the Respondent no.2-ICICI Bank. The petitioner by way of present petition seeks following relief:
"(i) to issue a writ, order or direction in the nature of mandamus directing the respondent bank to receive the loan amount in easy installment if any due against the petitioner.
(ii) to issue a writ, order or direction in the nature of mandamus directing the respondent bank not to charge compounding interest and other expenses and provide the statement of account and no coercive action may be taken against the petitioners." After arguing for some time, instead of pursuing the petition, the petitioner prays for withdrawal of petition with liberty to avail remedy before appropriate forum. Prayer is allowed.
Petition stands dismissed as withdrawn with the said liberty.
