This writ petition has been filed for the following relief:-
"I. issue a Wwrit, order or direction in the nature of mandamus directing the respondent No. 2, Superintendent of Police, Ballia to make a character certificate of petitioner being eligible for the same as per requirement for appointment as a agent of fair price shop.
II. issue a Writ, order or direction in the nature of mandamus directing respondent No. 2 to proceed for making a character certificate of petitioner as per requirement for appointment as a agent of fair price shop applied on compassionate ground."
Learned counsel for the petitioner submits that the petitioner has applied for issuance of character certificate before the Senior Superintendent of Police, Ballia (respondent no. 2), which is necessary for running of a fair price shop, but till date his application has not been considered and the same is pending before him. Therefore, the inaction on the part of respondent no. 2 is legally not justified.
Heard learned counsel for the parties and perused the records.
Considering the facts and circumstances of the case, without entering into the merits of the case, we direct the Senior Superintendent of Police, Ballia (respondent no. 2) to take decision on the application of the petitioner for issuance of character certificate, which is required by him for running of fair price shop, expeditiously, preferably within a period of three weeks from the date of receipt of a certified copy of this order.
With the aforesaid direction, the present writ petition is disposed of.
