JUDGMENT / ORDER

Earlier it was represented that steps have to be taken to bring on record the legal representatives of some of the deceased respondents. However subsequently, the learned counsel for the appellant who has filed Vakalath reported that he had handed over the bundle to the parties and requested this Court to direct the Registry to issue notice to the appellants. Accordingly this Court directed the Registry to issue notice to the appellants returnable on 16.12.2016. Despite notice has been served on the appellants, there was no representation for the appellants. Since the respondents 2 to 4 reported that steps due, this Court in stead of dismissing the appeal for default, gave one more opportunity and directed the Registry to print the name of the appellants. Even on the next hearing is on 10.01.2017, there was no representation for the appellants. Hence, the matter was directed to be posted under the caption for dismissal.
2. Despite the matter is posted today under the caption ?for dismissal?, there is no representation for the appellants. Hence, this Court find no reason or justification in showing any indulgence to the appellants. Hence, the Appeal Suit is dismissed for non-prosecution. No costs. Consequently, connected Miscellaneous petitions are closed.
