Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed for modification of condition imposed by this Court while enlarging the present applicant on temporary bail vide order dated 12th March, 2012 as recorded in Criminal Misc. Application No.2889 of 2012 to the extent that the condition of Rs.5,000/- be dispensed with by this Court.
From application itself, we find that the applicant intends to go for construction of his house.
Considering these aspects, the request of the applicant that the condition of depositing of Rs.5,000/- be dispensed with, does not inspire the confidence. Hence, the application is rejected. Rule discharged.
