Heard Mr. Nanavati, learned advocate for the petitioner.
Mr.
Nanavati, learned advocate for the petitioner, has submitted that present petition is exactly identical to the writ petition being Special Civil Application No.5919 of 2012 and the issues as well as subject involved in both matters are similar and identical. He, on such ground, requested for similar order as has been passed on 24.4.2012 in Special Civil Application No.5919 of 2012. He has, however, submitted that the said order dated 24.4.2012 was passed considering the fact that, at the relevant time, any order of recovery was not passed and was not placed on record, however, now, the recovery order is passed on 30.4.2012 and is served on the petitioner.
Mr.
Nanavati, learned advocate for the petitioner, seeks to place the said order dated 30.4.2012 on record by way of Draft Amendment. The Draft Amendment is granted. The amendment to be carried out forthwith.
In view of the aforesaid submission, below mentioned order is passed:-
Notice returnable on 22.6.2012.
By way of ad-interim relief, operation of the order directing recovery of specified amount from petitioner's salary shall remain stayed, until the next date of hearing.
