In pursuance of the judicial order of learned Single Judge of this Court dated 18.9.2018, the matter has been placed before this Court as fresh by the Registry of this Court.
Heard Sri S.K. Tiwari, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the respondent no. 5 to decide case crime no. 303 of 2015 under sections 198A (2) U.P.Z.A. & L.R. Act, pending in the court of respondent no. 2, U.P. Zila Magistrate, Meja, Allahabad in pursuance of F.I.R. dated 22.8.2015 pending in the court of respondent no. 2-Up Zila Magistrate, Meja, Allahabad.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He lodged the present F.I.R. on 22.8.2015 but till date the case has not been decided.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we direct the respondent no. 2-Up Zila Magistrate, Meja, Allahabad to decide the aforesaid case expeditiously preferably within a period of four weeks from the date of production of a certified copy of this order in accordance with law.
