JUDGMENT / ORDER

Upon instruction from the petitioner, the learned advocate for the petitioner seeks permission to withdraw this application at this stage.
Permission is granted.
This application stands disposed of as withdrawn.

3 Learned counsel for the petitioner submits that, since the condition No.5 of the said order is suspended for a period of ten years, the passport of the petitioner be renewed for a period of ten years and, in support of the said submission, reliance is placed on the notification published in the Gazette of India, Extraordinary, Part II, Section 3 -sub-section (1), issued by the Ministry of External Affairs, dated 25.8.1993, and, therefore, appropriate direction may be issued. It is not in dispute that the passport of the petitioner is renewed for one year.
4 Having heard the learned counsel for the petitioner and on perusal of the record, in my view, it is absolutely the discretion of the Regional Passport Authority/Officer to consider the individual case and, simply because condition No.5 is relaxed for a period of ten years and the petitioner can leave the country of his native during such period, ipso-facto, would not amount that a direction can be issued to the Regional Passport Authority/Officer to renew the passport of the petitioner for ten years. In absence of any merit, this petition is rejected summarily.
